Terms of Service

1. Agreement
By accessing or using the Pocavi platform and website ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to Pocavi Ltd ("Pocavi", "we", "us"), a company registered in England and Wales.
2. Service description
Pocavi is a Salesforce operations platform providing metadata backup and recovery, deployment management, GDPR compliance tools, data management, DevOps pipelines, and org health monitoring. The Service is provided on a subscription basis.
3. Eligibility
You must be at least 18 years old and have the authority to bind your organisation to these terms. By registering, you represent that the information you provide is accurate.
4. Accounts
You are responsible for maintaining the security of your account credentials. You must notify us immediately at sam@pocavi.ai if you suspect unauthorised access. We are not liable for losses arising from unauthorised use of your account.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to gain unauthorised access to our systems or other users' data.
- Interfere with or disrupt the Service.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service to store or transmit malicious code.
- Resell or redistribute the Service without our written consent.
6. Subscriptions and payment
Subscriptions are billed monthly or annually as selected at sign-up. Prices are listed on our pricing page and may change with 30 days' notice. All fees are non-refundable except where required by law.
7. Data and Salesforce access
You grant Pocavi permission to connect to your Salesforce organisation(s) via OAuth to provide the Service. We access only the metadata and data necessary for the features you use. You retain full ownership of your data at all times. See our Privacy Policy for details on data handling.
8. Service availability
We aim for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control, including Salesforce platform outages.
9. Intellectual property
All intellectual property in the Service (code, design, trademarks, documentation) belongs to Pocavi Ltd. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes.
10. Limitation of liability
To the maximum extent permitted by law, Pocavi's total liability for any claim arising from the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
11. Indemnification
You agree to indemnify Pocavi against claims arising from your use of the Service, your breach of these terms, or your violation of any third-party rights.
12. Termination
Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your access immediately if you breach these terms. Upon termination, your right to use the Service ceases and we will delete your data within 90 days unless you request an export.
13. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes
We may update these terms from time to time. Material changes will be communicated via email or an in-app notice at least 30 days before they take effect. Continued use after changes constitutes acceptance.
